The terms “Company”, “we”, “our”, “us” refer to Blackbelt Leaders. The terms “Sites(s)" refers to the company websites – www.BlackbeltLeaders.co.uk, amongst others (“Site(s)”).

The term “user,” “customer,” “member”, “student”, “you,” and “your” refers to visitors, users and customers of the Site and/or Service.

By accessing the Site and/or Service, you accept, agree and understand that you are fully responsible for your progress and results from your participation. We do not guarantee that you will get any results using any of our ideas, tools, strategies or recommendations, and nothing in our Site and/or Service is a promise, warranty or guarantee to you of such results.
Every testimonial our website is from the members of Blackbelt Leaders who followed our programmes, workouts, martial arts programmes, fitness classes, and nutrition/diet advice given by our personal coaches, instructors, and group-fitness coaches.
No one was paid for a testimonial or endorsement on our website. And all testimonials are available at Blackbelt Leaders, The Dojo Worthing.
Any before and after photographs of members were not retouched or altered in any way. Results (weight loss, body fat percentage, fitness improvement, circumference measurements, etc if any) were provided by the individual member and therefore cannot be confirmed. Errors could have been made in reported weight loss.
Weight loss and fitness results vary depending on the person. No guarantee is provided or implied.
Results may vary based on each member’s physical health, diet and exercise, and consistent adherence to the Blackbelt Leaders. If weight loss results are described in Blackbelt Leaders member’s testimonials, photos or videos you understand that these are not typical for every individual, and again, no guarantee of weight loss, fat loss, or fitness improvement results is provided or implied.
Individual results highly depend on the adherence the nutrition plans as well as following the fitness and weight loss programmes designed for them by Blackbelt Leaders and Blackbelt Leaders Coaches.
The causes of being overweight or obese vary from person to person based on individual metabolic rates, caloric intake caloric expenditure, daily activity, levels of exercise and physical exertion.
This means weight loss results will also vary from person to person. No individual result as stated by members of Blackbelt Leaders in their testimonials should be seen as typical.
You should assume that any weight loss, fitness or medical results shown in testimonials, advertisements, stories, blog posts, or anywhere else on our website are not typical. Typical weight loss is 2 to 3 kgs per month when an individual consistently follows a sound nutrition and exercise programme designed around best practice guidelines. Blackbelt Leaders recommends a healthy lifestyle programme and a long term approach to body fat reduction, strength gain, and fitness improvement. Any dramatic body changes will need dietary discipline, regular exercise, and hard physical work.

TERMS OF MEMBERSHIP AT BLACKBELT LEADERS

Any programme purchased from Blackbelt Leaders is on the clear understanding that:

1. Blackbelt Leaders provides it's services for 48 weeks of the year.

2. The programme has to be paid despite irregular or non-attendance, unless cancelled in the agreed manner detailed below.

3. Tution payments are for martial arts tuition only.

4. Testing / Graduation fees are in addition to tuition fees and are payable before testing and graduation.

5. You will be informed of any equipment pack or annual memberhip fee you may need for your training.

6. On occasion class timetables and venues may change however payment for the programme remains due.

7. Where you have taken advantage of the savings available by choosing to pay for your tution fees in advance no refunds are refunds are given at any point even if you decide to discontinue your training.

8. From time to time we will need to contact you about your membership, so it's important you let us know in writing or email if your address, contact phone number or email address changes. We will not be held responsible in any way if you fail to keep us updated in a timely manner.

9. We do not accept liability for damage or loss to your property or a guest's property that may happen on our premises or within the grounds of our premises or any premises we hire, other than the liablity which arises from our negligence or our failure to take reasonable care.

10. You are fit and healthy, have no pre-existing conditions that could be affected by physical exercise.

CANCELLATION OF MEMBERSHIP

As a student of or a parent of a student at Blackbelt Leaders you fully understand and accept that payment remains due for your programme despite iregular or non-attendance.

Your agreement can be cancelled at any time by giving One Calandar Months Notice. You also understnd that during the One Calandar Months notice period payment will still remian due and your programme will remain active until:

1. Written Notification Has Been Received By The Company.
2. You Have Made The Final Payment To The Company
3. You Have Canceled The Standing With Your Bank.

Any returned cheques, missed payments or over payments wil be subject to a £15.00 adminstration charge.

Furthermore you undertsnd that the fee is for martial arts tution only and does not include any testing or graduation fees or additional cources that you wish to attend.

Where you have elected to take advantage of the tuition savings available by paying for your tution fees in advance all sales are final and no refunds are given.

CANCELLATION DETAILS

a. We calculate your memberhip in whole calandar months. This means that the following applies

Where we ask you to give notice of one caladar month, if you give notice during a month, we will treat it as if we recieved it on the first day of the following month and the notice period will run from that day.

For example, if you need to give us one months notice to end your memberhip and we recieve your notice on 23 May, your notice will start from 1 June, it will run out on 30 June, your membership will end on 30 June, and you will pay one more standing order (in June on your usual payment date) after giving notice.

The only exception to this is if you give us notice at the beginning of a month. This means that if we receive notice from you up to and including the fourth day of the month, we will treat it as if we received it on the first day of that month and the notice period will run from that day.

b. If you want to give notice, it must be in writing. We will accept notice by email (please send to [email protected]).

c. Your notice is not effective until we have received it in writting. We strongly advise that when you give notice you get proof that we have received it. For example; if you send us notice by post, send it by recorded delivery so we have to sign the delivery notice when we receive it). If you deliver your notice by hand, ask for a receipt, or if you send us your notice by email, ask for a delivery receipt.

d. We will confirm we have received your notice within 10 days of receiving it. If you do not receive this confirmation within 10 days, you must immediately let us know so we can check whether it has been received.

e. If we need to give notice to you it will be effective if we send it to the address or email address we have in the records we hold about you, and if we give notice during a month, our notice period will run from the first day of the following month. We will not be held responsible in any way for any losses you may inccur as a result of you not keeping us updated with you current contact details.

BY ACCESSING THIS SITE

You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”) are maintained for your personal use and information by Blackbelt Leaders (the “Company”) and are the property of the Company and/or its third party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. SINCE THESE FACTORS DIFFER AMONG ALL INDIVIDUALS, THE COMPANY CANNOT AND DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS OR GUARANTEES REGARDING YOUR SUCCESS OR RESULTS. THE COMPANY DOES NOT WARRANT THAT USE OF THE MATERIALS WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE, THE CONTENT, AND/OR THE MATERIALS AVAILABLE ON THIS SITE ARE FREE FROM BUGS OR VIRUSES OR OTHER HARMFUL COMPONENTS. ANY SUCH PROBLEM SHALL BE GOVERNED SOLELY BY THE AGREEMENT BETWEEN YOU AND THAT PROVIDER. THE COMPANY RESERVES THE RIGHT TO DETERMINE, IN ITS SOLE DISCRETION, WHETHER THE COMPANY IS RESPONSIBLE FOR ANY SUCH MALFUNCTION OR DISRUPTION. THE COMPANY ALSO RESERVES THE RIGHT TO LIMIT YOUR USE OF THE SITE AND/OR THE CONTENT OR TO TERMINATE YOUR ACCOUNT SHOULD THE COMPANY DETERMINE THAT YOU HAVE VIOLATED THESE TERMS OF USE, OR THAT YOU HAVE VIOLATED ANY OTHER RULES OR CONDITIONS OF THE COMPANY. THE COMPANY RESERVES THE RIGHT TO REFUSE ACCESS TO THE SITE AND/OR THE COMPANY’S CONTENT, PRODUCTS AND/OR SERVICES TO ANYONE IN ITS SOLE DISCRETION. THE COMPANY MAY, IN ITS SOLE DISCRETION, REFUND THE INITIAL FEE CHARGED FOR ANY USE OF THE SITE AND/OR ANY CONTENT OR A PRO-RATA PORTION THEREOF CONSISTENT WITH THE COMPANY’S REFUND POLICY. THE COMPANY SHALL REFUSE ANY REFUND THIRTY (30) DAYS AFTER YOUR PAYMENT FOR USE OF THE SITE AND/OR ANY CONTENT, EITHER PURSUANT TO THE COMPANY’S CUSTOMER LICENSE AGREEMENT OR OTHERWISE, REGARDLESS OF THE REASON FOR DISRUPTION.

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS, OCCASIONED BY ANY DEFECT IN THE SITE, THE CONTENT, AND/OR RELATED MATERIALS, THE INABILITY TO USE SERVICES PROVIDED HEREUNDER OR ANY OTHER CAUSE WHATSOEVER WITH RESPECT THERETO, REGARDLESS OF THEORY OF LIABILITY. You agree to indemnify and hold the Company and each of its directors, officers employees, and agents, harmless from any and all liabilities, claims, damages and expenses, including reasonable solicitors' fees, arising out of or relating to (i) your breach of this Agreement, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services that the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users of the Site or the services. The Company reserves the right to assume the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide the Company with such cooperation as is reasonably requested by the Company.

13. If you wish to review your terms of your private membership to Blackbelt Leaders Martial Arts Dojo they can be found on the reverse of your Membership Agreement with Blackbelt Leaders. 14. The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

15. This agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the courts sitting in Worthing, West Sussex, UK. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

16. We reserve the right to update any portion of our Site and/or Service, including these Terms of Service at any time. Such amendments are effective immediately upon notice to you by us posting the new Terms of Service on this Site. If you have provided us your email address, we will also email you to let you know of material amendments to our Terms of Service. Any use of the Site and/or Service by you after an amendment is made means you accept these amendments.
